Gogoi was first arrested on December 12, 2020 in Jorhat after an anti-CAA rally. The case shifted to Nia two days later and she was ordered on charges of incitement and in the provisions of the activity that violated the law (prevention) of ACT (UPA) for being suspected of being an overground worker from the CPI that was prohibited (Maois).
Some cases were submitted against Gogoi at the police station in cities in Assam – Sibsagar, Dibrugarh, Gaurisagar, Tok, Jorhat – after violence, where two (Chandmari and Chabua) were taken over by Nia. In both cases, he was charged with incitement and UPA, among other violations.
Gogoi was cleaned from all cases against him, including Chabua’s case, last month. However, the defense of the guarantee for the Chandmari case was rejected by the Gahati High Court in January and then by the Supreme Court in February, his lawyer said. After Gogoi was cleaned in the case of Chabua in June, Nia has introduced additional chargesheets in the Chandmari case.
“But today he has run out and free of all charges. This is the 120-page judgment. The court said that the witnesses were not found eligible in the chargesheet submitted,” said Advocate Gogoi.
In the case of Chandmari, Gogoi was ordered with various charges including part 120B, 124A, 153B IPC and parts 18 and 39 languages. The Gogoi Association of Kristi Mukti Sangram Samiti, the farmer organization he established – Manas Konwar, Dharjya Konwar and Bittu Sonowal – also accused of FIR. Everything has been cleaned.
Gogoi has long been anxious for the rights of farmers in Assam. He has also been vocal about the problem of land rights, eviction, large dam projects, among others. In this year’s country election, Gogoi, who led the new regional Raijor Dal party was formed, became the first imprisoned leader at Assam to win the assembly selection. He won from the Sibsagar chair on Assam with a margin of 11,875 votes.
In July 2020, Gogoi was treated in Gautati Medical College and hospital after testing positive Covid-19. After that, he remained in the hospital because of other health problems. Last week, he was given a conditional release of 48 hours to visit his sick mother, Priyada Gogoi, 84. His involvement in the Gogoi election campaign was believed to have given a big boost, which led to his victory.
